RN Services Under Arrangement. A Defined Regulatory Framework.

The New York regulatory framework governing contracted RN assessment services, agency accountability, personnel qualifications and clinical documentation.

RN Services Under Arrangement

May a LHCSA obtain RN assessments under a contractual arrangement?

Yes, subject to written contractual terms and continuing LHCSA oversight. Under 10 NYCRR 766.10(a), the governing authority or operator may contract with individuals or organizations to obtain patient care services. Subsections (b) through (e) establish requirements for written agreements, personnel qualifications, retained agency responsibility and clinical liaison.

CareBridge’s RN assessment services are provided within the scope of the agency’s executed service agreement. That arrangement must identify the services to be performed, the supervision and evaluation process, and the procedures for integrating assessment findings into the agency’s plan of care and clinical record.

Agency Accountability

Contracted Clinical Support.
Continuing Agency Oversight.

CareBridge provides assessment, documentation and coordination support within the agreed scope of services. The contracting LHCSA retains responsibility for service adequacy, regulatory compliance, clinical supervision and adherence to each patient’s plan of care.

Operational duties, reporting requirements and approval responsibilities are established in the executed service agreement and applicable agency policies. This framework should be read together with those documents and the governing regulations.

Agency Compliance Checklist

  • Keep the signed service agreement on file.
  • Arrange agency review of the visit documentation; CareBridge targets documentation turnaround within 24 hours after the RN visit.
  • Obtain your DPS’s approval of every Plan of Care before finalization and integrate completed visit records into the patient’s clinical file.
  • Maintain direct communication with CareBridge’s clinical coordinator.
  • Keep a process for responding to urgent clinical findings reported by the RN.
  • Make credential verification records accessible for regulatory review.
  • Obtain required practitioner signatures and authorization for the plan of care.

Registration, Credentials & Insurance

Agency onboarding should include review of CareBridge’s registration certificate, applicable insurance documentation and the credential requirements for assigned RNs. Record-access and verification responsibilities should be established before services commence.

Confidentiality & Clinical Information Exchange

Patient information must be exchanged through the process agreed with the agency, with access limited to authorized recipients. Public inquiry forms are intended for business inquiries and must not contain patient records or protected health information.
